Vacation Rental Contract

THIS VACATION RENTAL CONTRACT (“VRC”) is made by and between TechTravel.com (“Tech Travel”), 3112 Pass A Grille Way, St Pete Beach, FL 33706 and (“Guest”) as of the date on the signature page of this Agreement. For rental of the property, the sufficiency of which is acknowledged, the parties hereby agree as follows:

  1. Rental Party: The rental party shall consist of the Guest and his/her guests not to exceed the maximum occupancy of _Guest selected for this booking___.
  2. Term of the Rental. The Rental begins at 4p.m. on _Arrival Date___ and ends at 11a.m. on __Departure Date___.
  3. Damage Waiver Fee: A nonrefundable Damage Waiver Fee between $25.00 to $199.00, depending upon the property, was charged in lieu of a deposit when you booked your stay.  GUEST is responsible for any and all damages exceeding the Accidental Damage Max Coverage amount applicable to the Damage Waiver Fees, as follows:

This chart is only for your reference to determine the amount of Accidental Damage that is covered by the damage waiver you have already agreed to when confirming your reservation. Additional information relative to the Damage Waiver Fee is contained within this entire VRC and is also specifically addressed in section 7.

  • Travel insurance is available upon request. 
  • House Rules and Regulations:  THE GUEST IS RESPONSIBLE FOR THE OTHER PERSONS IN THE HOUSE AND SHALL NOTIFY THEM OF THE HOUSE RULES AND REGULATIONS BEFORE CHECK IN. The following provisions supplement any and all specific House Rules and Regulations:
  • Furniture: Please do Not move Furniture around. If inside and/or outside furniture is moved by the Guest and/or their guests, and is Not placed back in its original location, the Guest will be charged for Tech Travel placing the furniture back in its original location. Please do Not stand on any furniture. Please do Not touch the TV screens as this could damage the LCD. If damage results from Moving, touching or using the furniture improperly (i.e. scratches to floors, dings on wall, fingerprints on tv, etc.) you will be charged for repair and/or cleaning.
  • Access: Guest shall allow TechTravel.com/ TechTravel.com, and or an agent of Brandon Tecklenburg/TechTravel.com or the owner access to the property for purposes of repair, inspection, or to show for rent. This right of access will be exercised in a reasonable manner and given advance notice.
  • Fishing: Nonresidents who are 16 years of age or older are required to have Florida hunting, freshwater fishing or saltwater fishing licenses. A fishing license is required to attempt to take fish. No Illegal Fishing Devices such as Spears, Spear Guns, Etc., allowed.
  • Vehicle Parking- Vehicles will be towed for violating parking rules. The Sheriff’s department will charge high fees for parking violations, so please be clear on where you park. Park in designated parking for this property. Park in the garage (if applicable) at the house prior to parking anywhere outside. Parking is limited to onsite spaces, in the garage (if applicable), and driveway only. Violators of the parking rules are subject to Fines, and towing. Please do Not park in any of the neighbor’s driveways. Do Not block the road or another properties driveway. If your car or any cars in your party are leaking fluid, please use something to keep it from leaking on the driveways and/or garages. Any oil stains, anti-freeze, transmission fluid, etc., left on the driveway pavers, or in the garage will result in your deposit being charged for replacement and/or cleaning. Driveway pavers are costly to replace and can Not be pressure washed, acid washed, or anything similar and must be replaced entirely as they are very porous.
  • Grill: If the house you are renting has a propane BBQ: do Not for any reason add or put charcoal in the BBQ. If you do there will be extra cleaning fees and/or repair fees.
  • Smoking: No Smoking inside the property. If you are smoking outside it is your responsibility to clean up any and all cigarette butts. Evidence of smoking in the house will result in total forfeiture of your deposit. You will also be charged for steam cleaning and damages. Any picking up of cigarette butts in the yard, driveway, and patio could result in extra cleaning fees. Please clean up after yourself.
  • Pets: No Pets are permitted unless specifically authorized in the introductory portion above.
  • Emergency Services: $150 minimum charge if management, security, fire department, police or emergency officials are called to the property for any type of disturbance other than medical emergency.
  • All strollers, Kayaks, Paddle Boards, Beach Chairs, Beach umbrellas, etc., are only allowed in the garage, mud rooms, and/or designated area. These items can cause damage to hardwood floors, carpet, and walls and are Not allowed in the house.
  • Fireplace: If your house has a gas or electric fireplace: Any evidence of the gas or electric fireplace having wood use will result in total forfeiture of your deposit plus any additional cost of repair or replacement. No use of fireplaces without consent from Tech Travel.
  • Lost Items: The guest is to notify us of any item(s) left behind. These will be held for a period of 30 days then disposed of. Guest is responsible for shipping charges to return. TechTravel.com is Not responsible for any lost or stolen property.
  • Cleaning: Please do Not use anything abrasive on the stainless-steel appliances, if something sticky gets left on them, leave them alone and the cleaning crew will take care of it. We use specialty cleaners for the stainless-steel appliances.
  • Damage Waiver: As stated, GUEST is responsible for all damages in excess of the Damage Waiver Fee Coverage Amount.  Violation of House Rules, physical damage to the property and any and all contents shall entitle TECH TRAVEL to seek recovery from GUEST.
    • If any emergency, damage, injury, or maintenance issue occurs at the property, please call 727-808-2791 IMMEDIATLEY to report the problem. If there is no report of the problem and excess damage occurs as a result, you will be held responsible for repairs and any other costs, charges, lost rents as a result of the damage. You MUST notify us immediately, 727-808-2791, of any pre-existing damage or housekeeping problems to the house. Do Not let them wait, or try to repair them yourself as this will only cause excess damage and the cost will revert back to the security deposit and any excess charged to your credit card. We will make every effort to correct the problem as soon as possible. We cannot be of assistance if we are unaware that a problem exists and notification after departure will not be acceptable for exemption from damage discovered during the walk through after you depart. Housekeeping problems will not be cause for compensation or refund, especially if we are notified after departure.
    • Specific examples of potential damage are including, but not limited to, the following:
      • Any lost or misplaced keys and/or Parking passes will be charged $50+ Fee for replacing
      • More than the maximum people staying overnight;
      • Any excessive loud noise between the hours of 10pm­9am;
      • Weddings, receptions, parties, gatherings, or any other Events which have not been specifically authorized by TechTravel.com prior to Booking;
      • Smoking indoors or failing to remove evidence of smoking from exterior areas of the Property;
      • Use of illegal drugs of any kind on the property;
      • Presence of pets without prior authorization;
      • Early Check-In and/or Late Check-Out;
    • Tech Travel reserves the right in the following circumstances to evict the Guest and all occupants; and, to consider the same an intentional forfeiture of any payment(s):
      • Gross misconduct, committing illegal acts of any kind, damage, disturbing the peace, higher than permitted occupancy than agreed, unauthorized use for weddings, receptions, parties or loud group functions are Not permitted.
      • Presence of pets without prior authorization;
      • Any rental reservation made under false pretenses will be subject to forfeiture of advance payment, security deposit and/or rental money, and the party will not be permitted to check in or will be checked out when any offense occurs even if it is before original check out date;
      • Any other cost incurred by owner due to Guest’s stay;

MISCELLANEOUS TERMS AND INFORMATION

The following terms and information supplement the VRC and serve to provide additional information for reference and use, if necessary:

  1. UTILITIES: The Vacation Rentals include all utilities, Water, Trash Removal, Gas, Power, TV, Wi-Fi.
  2. DAILY MAID SERVICE – While linens and bath/beach towels are included, daily maid service is not included in the rental rate. Maid service is available at an additional rate Per hour, per housekeeper. We do not permit bathroom towels or linens to be taken from the house to the beach, we do provide beach towels.
  3. RATE CHANGES – Rates subject to change without notice prior to booking. No refunds from prior rate.
  4. CHECK-IN/CHECK-OUT: Check in is after 4 p.m. and check out is at 11 a.m. *There are no unauthorized early arrivals or late departures without Tech Travel approval. If we discover that you have, without authorization, checked in before 4pm OR checked out prior to 11 a.m. will result in a prorated fee based on your Nightly Rate. If Housekeeping is unable to clean the property that you have rented as a result of an Unauthorized Late Check Out, you will be billed an $99 fee on top of the prorated fee for a late check out.
    1. CHECK-OUT PROCEDURE:
      1. Gather all used towels and leave in laundry area or in bath area if your unit does not have a washer and dryer.
      2. Take out all trash (Kitchen, Bathroom, and Bedroom) and recycling material to the outside garbage and/or recycling bins, Do Not Leave garbage inside the home when you leave. No lose trash inside or outside as you are on the beach and it will attract Seagulls, Fruit Rats, and Cock Roaches or you will be charged for extra cleaning. Trash pickup on the beaches is on Tuesday and Friday, Recycling is picked up on Wednesday.
      3. Please start the dishwasher/wash dishes on your way out, do not leave dirty dishes in the sink.
      4. If you used a BBQ grill and utensils please make sure it is clean and looks like it did when you arrived at the home.
      5. Please do not move indoor furniture around.
      6. All beach chairs and beach supplies that are used need to be rinsed off of sand prior to putting away.
      7. Set thermostats Heat to 65 degrees or the AC to 79 degrees upon departure.
      8. Turn off all lights.
      9. Close all windows.
      10. Lock the doors and place the key back in the lock box (if applicable) and tumble the lock code so the combination is Not showing.
  5. AMENITIES PROVIDED & NOT PROVIDED – We do Not supply items such as; plastic wrap, foil, plastic bags, spices, oils, coffee etc. We will provide starter Hotel size Shampoo, Conditioner, Body Wash, 2 rolls of toilet paper per bathroom, 1 roll of paper towels, 2 Kitchen Trash Bags, 1 Beach towel per person, 2 bath towels, 1 hand towel and 1 wash cloth per person, linens, blankets, and pillows. We also supply basic pots and pans, flatware, plates, glasses, bowls, and basic cooking utensils. As every property is privately owned items in kitchen may vary from house to house.
  6. POOL AND HOT TUB RULES (IF APPLICABLE) – Use of outdoor pool and/or hot tubs is prohibited between the hours of Midnight and 8am. Please be aware of locking straps on the lid of the hot tub: unlock/unhook BEFORE you try to open the cover. We inspect the pool and/ or the hot tub before check in and after check out; any broken strap or lock as a result of your misuse will result in a fee to replace broken parts. If you drink in the pool and /or the hot tub, please be careful not to spill any alcohol in the water. We do test the pool and/or the hot tub after each Guest for fluids and if there is evidence of such, we will charge your deposit for a complete drain and refill, new chemicals and or extra cleaning of the pool and/or the hot tub. This fee will be a minimum of $150. There will be a minimum of $150 fee if the pool and/or the hot tub are misused, causing a drain and fill. Example: if you overloaded the hot tub with people and the water has been displaced very far below the line of the jets. Please be sure to replace any covers and locks that were removed during your stay prior to check out. You must be 18 years or older to use the hot tub. The pool and/or the hot tub are serviced before, after, and sometimes during (depending on your length of stay) every rental to insure the water is safe to use. If there is any issue with the pool and/or hot tub upon your ARRIVAL, please notify us immediately. USE POOL AND/OR HOT TUB AT YOUR OWN RISK, We are not held liable for any skin irritation that may be caused by the use of the pool and/or hot tub. Children should be supervised at all times by an adult.
  7. ACCESSORY DEVICES AND EQUIPMENT: We do our best to maintain operation of indoor & outdoor items (Jacuzzi, Barbecues, patio furniture, table games, TVs, internet, etc.). Should maintenance to these items cause temporary loss of use, that will Not be a cause for refund or compensation. All Guests will be promptly notified prior to arrival if such conditions become apparent. If such items become inoperable during your stay and only if we are notified, we will do our best to get items back up and running during your stay.
  8. CANCELLATIONS MUST BE MADE IN WRITING. CANCELLATIONS MADE WITHIN 60 DAYS OF ARRIVAL DATE ARE SUBJECT TO TOTAL FORFEITURE OF ALL FEES. CANCELLATIONS MADE PRIOR TO 60 DAYS OF ARRIVAL DATE ARE SUBJECT TO A PENALTY UP TO AND INCLUDING 50% OF THE RESERVATION COST. I authorize my credit card to pay for all damages, missing items, or other costs caused by any member of my party in excess of the coverage of the Damage Waiver Fee. It is your responsibility to inform of any potential problems with your reservation or to make alternate payment arrangements. Any alternate payment arrangements must be in writing and mutually agreed upon by Guest and TechTravel.com/ TechTravel.com – NO EXCEPTIONS. THERE ARE NO REFUNDS FOR ANY REASON within 60 DAYS prior to check in date. By initialing this contract section, you are agreeing to adhere to the cancelation policies above. 
  9. ACTS OF GOD: During stormy weather, forest fires or other acts of God, no refunds unless all roads to Pinellas County Beaches are completely closed for twelve (12) consecutive hours or more prior to the date of your arrival.   10. RIGHT TO INSPECT: Management Reserves the right to inspect the property for over occupancy, noise or other violations of City, County, and State Laws. Occupants may be subject to fines in accordance with the County or State, eviction and Forfeiture of rents and deposits if found to be in violation.
  11. CREDIT/DEBIT/CHARGE CARD AUTHORIZATION AND PAYMENT: If your credit card is declined at the due date, this is cause for your reservation to be cancelled and all fees paid forfeited 100%. Keys, directions and entry instructions will not be provided until full rent is paid and contract is received.
  12. Occupants agree to hold property owners and TechTravel.com/ TechTravel.com harmless of any damage to self or property resulting in accident, loss or injury due to rain, flood, negligence, defective construction, fire, theft, utility power outages, or any reason. Please call 727-808-2791 IMMEDIATLEY when reporting an accident at the property. I agree to fully and forever release and discharge, TechTravel.com, TechTravel.com Employees, and TechTravel.com Property Owners for any injuries or damages sustained by myself, of my guest, or anyone under the custody, care, and control, including property damage that may result from arise out of or be related in any way to my rental and stay at the Property. If any portion of this Document shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Document and the remainder of the Document shall not be affected and shall be valid and enforceable to the fullest extent permitted by law. 

After placing this reservation, you will receive an e­mail within 2 business days along with a receipt for your booking. Once the final balance has been charged and the rental contract is signed, you will receive your check in instructions 2 to 7 Days Prior to arrival.

By placing this booking and clicking the box below, “I have read and accept the above rental policies agreement”, you agree and authorize your credit card or checking account to be charged at the time of booking for the security deposit and the full amount of the booking to be charged no later than 60 days prior to arrival.

TechTravel.com/ TechTravel.com and/or the Owners of the property are Not liable for any accidents, injuries, deaths in pools, hot tubs, decks, docks, sea walls etc.

STORM POLICY/ROAD CONDITIONS: No refunds will be given for storms. Beach weather can be unpredictable, if there is no sun you are not entitled to a refund. If there is a government/state issued emergency for a Hurricane a full refund is available.

Do not under any circumstance disturb residential neighbors with loud voices and music during your stay. There is a noise ordinance on the beaches, 10p.m. to 8a.m. that is strictly enforced.

NOTE: We want our guests to enjoy their time on the beach, so we want to make you aware of certain conditions in the Gulf of Mexico, watch for stingray season, sea turtle season, and red tide postings. Bring plenty of moisturizer, lip balm, sunscreen and please stay hydrated. The sun is hot here and you will get burned.

Wildlife: The area is highly populated by birds, fruit rats, palmetto bugs, etc. Please DO NOT feed them or leave food out. Do not leave trash near the garage doors where they can smell it, do not leave food on the patios as racoons have been known to scale sides of the house and get onto the patios just to get the food’. Rodents are very invasive, so please feed them in the meadows or elsewhere. Thank you for your patronage and care while sharing this vacation home. We hope you had a wonderful stay.
